TERMS AND CONDITIONS
A. INTRODUCTION
i. Be 1 Scouting Tour– India 2023/2024 is organized by Be 1 Scouting & Production India Private Limited registered at H. No. 302 B4, Gurugram, Haryana, India-122002 with Corporate Identity Number U93090HR2022PTC107751.
ii. Be 1 Scouting Tour - India 2023/2024 is a prestigious modeling contest dedicated to discovering new Indian models and influencers across all genders and providing them with global career opportunities. Over a span of 10 months, from April 1st, 2023, Be 1 Scouting team will traverse more than 20 major cities and towns throughout India, seeking potential talents. At each step of the selection process, our Team from Paris and seasoned professionals of the Fashion Industry will be present.
During the preliminary auditions, our scouting team will meticulously evaluate various aspects of the candidates, including their natural look, attitude, charisma, catwalk skills, and overall potential. Successful candidates who pass the preliminary auditions and progress to the semi-finals or grand finale will have the chance to further showcase their talent and potentially be noticed by our top partner agencies from New York, Paris, London, Milan, Hamburg, and Barcelona. The 5 winners of the competition will be announced at the Grand Finale.This remarkable journey offers aspiring models an exceptional platform to kickstart their modeling careers and unlock exciting opportunities on a global stage.
iii. Each partner agency will be invited to watch online and in replay the semi-finals and preselect their favourite candidates. 70 senior and head bookers will attend the grand Finale in Delhi to choose the winners along with few famous designers, influencers, photographers, stylists, makeup artists and editors from top fashion magazines.
iv. During all steps of the selection, candidates can quickly establish new networks and gain insights which will kick start their modelling career. If they access the grand finale and do not have a mother agency prior the start of the contest, they will get the choice to sign exclusively with Be 1 Scouting & Production, Paris whose objective is to coach and manage models with fashion partners and international modelling agencies. Their picture(s) will be displayed on our website and be visible globally by all fashion industry for duration of 12 months at the end of the contest. In case any professional will be interested by their profile, our booking team will carefully take the request and will inform them. At each stage of the contest, they will be assisted by a team of professionals and will receive personal mentoring and counselling to reach their modelling dreams.
v. The contest will be opened to all, aspiring or professional models, WITH or WITHOUT a mother agency, from the age of 14 years onward:
§ Fashion models (from 5’7 for girls and 6’ for boys)
§ Commercial models (no height requirement)
§ Curvy models any age (5’5 for girls and 6’ for boys)
§ Senior models from 50 years onward (no height requirement)
§ Influencers with a minimum of 30K followers
§ The participation of a candidate below the age of 18 requires written permission by parents or guardians.Candidates below the age of 18 must provide written permission from their parents or guardians to participate. Additionally, it is mandatory for one of the guardians to be present during the audition. This measure ensures the safety and well-being of our young participants throughout the selection process. We prioritize the welfare of all contestants and strive to create a supportive and secure environment for everyone involved.
§ Your category will be assigned to you based on your characteristics.
vi. The website www.be1scouting.com, offers a modelling competition in the fashion sector from January 1st, 2023 and for an indefinite period. The website www.be1scouting.com and all rights attached to it are the exclusive property of the representatives/ owners/ directors. All brands, logos and other distinctive signs reproduced on the website and on websites to which it allows access through hypertext links, are the exclusive property of their owners and are protected as such by the provisions of the Intellectual Property Code for the whole world. Any unauthorized trademarks, in whole or in part, of these brands, logos and signs constitute an infringement punishable by criminal sanctions. All software used on be1scouting.com site and those to which it provides access, as well as the texts, comments, illustrations and images reproduced on the site and those to whom it provides access are subject to copyright and unauthorized reproduction is an infringement punishable by criminal penalties.
vii. We accept records from the people of Indian and Nepali origin and foreigners residing in India only. Anyone can apply in ‘Be 1 Scouting” however in case of minors they need to seek written permission from their parents/guardians. The online form should be filled appropriately with accuracy. Only fully filled in/completed form will be considered valid. If the documentation along with the form provided by you is not filled with limpidity or it is incomplete your claim may be rejected.
viii. In these terms and conditions, the organizer may be referred to as "We" or "Us".
ix. This site may be governed by different terms and conditions or privacy policies. In the event of a conflict between any terms or conditions of these Terms of Use or the Privacy Policy, on one hand and any other terms of use or privacy or other policies on the other hand, the applicable terms or conditions of these Terms of Use or the Privacy Policy shall prevail with respect to your use of the Site.
B. ACCEPTANCE OF TERMS
i. The services that Be 1 Scouting provides to any web site User is subject to the following Terms of Use (“TOU”). Be 1 Scouting reserves the right to update the TOU at any time without notice to User/ Applicant. The most current version of the TOU can be reviewed by clicking on the “Terms of Use” hypertext link located at the bottom of our Web pages.
ii. This Agreement, which incorporates by reference other provisions applicable to use of www.be1scouting.com, including, but not limited to, supplemental terms and conditions set forth hereof (“Supplemental Terms”) governing the use of certain specific material contained in www.be1scouting.com, sets forth the terms and conditions that apply to use of www.be1scouting.com by User. By using Be 1 Scouting (other than to read this Agreement for the first time), User agrees to comply with all of the terms and conditions hereof. The right to use www.be1scouting.com is personal to User and is not transferable to any other person or entity.
iii. By using www.be1scoutingcom you agree to the following terms and conditions that govern all of its members and site users. You also agreed to this contract between you, the user/ applicant, and www.be1scoutingcom when you clicked the “i agree” or “i accept” box during signup or if you are a non-member browsing www.be1scoutingcom.
C. REGISTRATION PROCESS
i. To register click on registration and fill up the online form mentioning your Instagram or Facebook profile for our reference.
*Note: Our schedule is subject to change based on the availability of our venue partners. We understand that unexpected adjustments may occur, but we will make sure to keep you informed about any new dates or modifications well in advance. Thank you for your understanding and flexibility throughout this process.
ii. Pay the registration fee of 500/- INR (including GST) to confirm your participation. You can make the payment through UPI by scanning our QR code or via bank transfer using the provided details.

iii. Within 7 working days of receiving your payment, we will send you an email of acknowledgment along with your unique application number.
iv. You will receive your invitation letter, including all the necessary details such as the audition date, time, venue, and dress code, 5 to 7 working days prior to the audition.

SEMI-FINALS & GRAND FINALE:
Upon selection for the Semi-Finals, a nominal fee of 2500/- INR (including GST) will be required for participation.
Likewise, if you qualify for the Grand Finale, an additional nominal fee of 3000/- INR (including GST) will be applicable.
These fees will cover the expenses associated with the respective stages, ensuring an unforgettable and transformative experience throughout your modeling journey.
The fees for Semi-Finals and Grand Finale include the following additional benefits:
Participate in a professional photoshoot and get your high-definition portrait photo taken within 3 months.
Showcase your exclusive photo on our website for 12 months when the contest concludes.
Opportunity to purchase additional photos to enhance your portfolio.
We offer various packages for purchasing additional black and white (B/W) photos from the photo shoot. These packages are designed to provide you with more options to showcase your talent effectively.

E. CHANGED TERMS
Be 1 Scouting shall have the right at any time to change or modify the terms and conditions applicable to User’s use of www.be1scouting.com, or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on www.be1scouting.com, or by electronic or conventional mail, or by any other means by which User obtains notice thereof. Any use of www.be1scouting.com by User after such notice shall be deemed to constitute acceptance by User of such changes, modifications or additions.
F. USER CONDUCT
i. User shall use www.be1scouting.com for lawful purposes only. User shall not post or transmit through www.be1scouting.com any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without Be 1 Scouting‘s express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a User that in Be1 Scouting’s discretion restricts or inhibits any other User from using or enjoying www.be1scouting.com will not be permitted. User shall not use www.be1scouting.com to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with Be 1 Scouting.
ii. www.be1scouting.com contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of www.be1scouting.com are copyrighted as a collective work under the Indian copyright laws. Be 1 Scouting owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. User may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. User may NOT download copyrighted material for User’s personal use. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of Be 1 Scouting and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. User acknowledges that it does not acquire any ownership rights by downloading copyrighted material.
iii. User shall not upload, post or otherwise make available on www. be1scouting.com any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with User. User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of www. be1scouting.com, User automatically grants, or warrants that the owner of such material has expressly granted Be 1 Scouting the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. User also permits any other User to access, view, store or reproduce the material for that User’s personal use. User hereby grants Be 1 Scouting the right to edit, copy, publish and distribute any material made available on www.be1scouting.com by User.
G. INTENDED USE OF THE SITE
i. The Site may contain materials such as software, text, graphics, images, video, audio and other material (collectively referred to as the “Content”). The Content may be owned by us or may be provided through an arrangement we have with others, including other users of the Site, and any Service Provider. You may not sell, transfer, assign, license, sublicense, or modify the Content or reproduce, display, publicly perform, make a derivative version of, distribute or otherwise use the Content in any way for any public or commercial purpose.
ii. The use or posting of the Content on any other website or in a networked computer environment for any purpose is expressly prohibited. If you violate any part of these Terms of Use, your permission to access and/or use the Content and Site automatically terminates and you must immediately destroy any copies you have made of the Content.
H. USE OF ACCEPTANCE
You must not use our website in any way that causes or may cause damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. You must not use our website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, root kit or other malicious computer software.
I. GENERAL TERMS AND CONDITIONS
i. Please consider that, in case you are under the age of 18 (minor), your application must be approved by your parents/legal guardian. We will not be in a position to consider your application, unless we receive your parental/legal guardian’s approval. This is why we ask you to provide us with an email address, telephone number and other data of your parent/legal guardian. In case of his/her refusal, or in the event the approval is not granted within 15 days from our request, we will delete all the data supplied by you in the application. Please remember that your parent/legal guardian contact information will be the only ones we will utilize, should we intend to contact you to propose a meeting. Please also remember that we will require that your parent/legal guardian attend any meeting we might propose to you in the future.
ii. We will utilize the information, the photographs and the personal data provided by you for the sole scope of a preliminary evaluation of your potential as a model. It is important you give us true and complete information in order to allow us to do such an evaluation. In particular, please verify you are legally in a position to provide us with the photos you are annexing herewith and that no third party (the photographer or others) may object to this.
iii. Your personal data will be stored with us and will be treated electronically or physically for the purposes indicated above. The storage and the treatment of your data will last for the period that is reasonably necessary in order to do the evaluation described above. Thereafter, your data will be deleted, should your application be unsuccessful. There might be exceptions, in cases in which, though we not be immediately interested, we might wish to meet you in the future. We will inform you and your parent/legal guardian, should this be the case.
iv. The panel of judges / evaluator’s decision will be final and no clarifications / complaints on the judgment will be accepted.
v. The applicant agrees to be on time at the shoot or event venue. The Applicant agrees to be present at the venue at least 30 minutes prior to the day and the time slot given to the applicant.
vi. The applicant agrees to inform us immediately or before the shoot schedule if he / she is late because of traffic or any problem due to which they are not able to reach on time at the venue. The applicant agrees not to give excuses such as but not limited to the following, ‘no balance’, ‘no signal’ or ‘no charge’. If this is the case, then applicant agrees to call from nearby public telephone.
vii. Be 1 Scouting reserves the right to deny entry to the event if the applicant does not follow the abovementioned protocols. No refunds of the registration fees shall be provided under these or any circumstances.
viii. The applicant agrees not to involve in any illegal activities defined by law. If found, Be 1 Scouting has rights to inform concerned authorities to take legal actions against the concerned person/s.
ix. The applicant agrees to keep all the information about the clients/ sponsors/ events/ selection process/ owners/ directors/ any other sensitive information confidential at all times which includes any given period of time even after the event is over.
x. The applicant agrees to treat the items being the jewellery/ clothing/ shoes/ bags or any other accessory that he/she is Modelling with the utmost respect. The applicant will be responsible for such outfit/ accessories from the time he/she is being provided with till the time said items are returned to the concerned person/s. Such items could also be subject to checks performed at any time to ensure for damages or it being stolen. If the applicant notice anything wrong with the clothing at any time (stain, rip, loose button, etc.), He / She will alert one of the helpers immediately. In an event of any damage or attempt of stealing any items which are being provided by us we reserve the right to retrieve the costs or report to the concerned authorities at all times.
xi. We have a strict policy against any kind of nuisance or unruly behaviour being it physical or verbal. The applicant agrees to behave polite and well-mannered. If any other person misbehaves, the applicant agrees to inform us or the concerned persons hosting the event. Such behaviour may lead to expulsion from the event without any refunds.
xii. Any form of discrimination and/or harassment within professional working environments will not be tolerated by Be 1 Scouting. If any of our applicant experience or witness discrimination, sexual and/or other unlawful harassment while working, we ask applicants to report it immediately to the Be 1 Scouting team available or at _____contest.india@be1scouting.com_____ all reported allegations of harassment, discrimination, or retaliation brought to the company will be investigated promptly, thoroughly, and impartially.
xiii. Applicants should not be found under the influence or in possession of illegal drugs/ contraband or alcohol before during or after the event (including the unauthorized use of prescription drugs. In case prescription drugs are required for the applicant’s health and medical safety purpose the applicant may disclose the same to the Be 1 Scouting team/ organisers and seek prior permission to use for the same). If in any case anyone is found abusing alcohol or drugs will be reported to the concerned authorities and will be expelled from the event with immediate effect without any refunds.
xiv. Carrying/ concealment and use of any kinds of Arms and Ammunitions are strictly prohibited. If in any case anyone is found carrying/ concealing or using any kinds of Arms and Ammunitions will be reported to the concerned authorities and will be expelled from the event with immediate effect without any refunds.
J. DISPUTES
i. In the event of any dispute regarding these Terms and Conditions, the Competition Information, mistake or dispute about the running of the Competition including the results or judging criteria, or the operation of any technical or communications systems (including the Website(s)), our decision shall be final.
ii. In case any differences or disputes shall arise between the parties hereto in relation to these presents or the rights or obligations of the parties the same shall be referred to an Arbitrator of choice of the organiser i.e. Be 1 Scouting for decision and award which shall be binding and conclusive upon the parties. The provisions of the Arbitration and Conciliation Act 1996 and any modification thereof shall be applicable. All such Disputes shall be within the Jurisdiction Delhi High Court.
K. GOVERNING LAWS AND JURISDICTION
These Terms and Conditions will be governed by the laws of India and are subject to the non-exclusive jurisdiction of the Indian Courts.
L. DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY
i. Applicant expressly agrees that use of www.be1scouting.com is at applicant’s sole risk. Neither Be 1 Scouting, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that www.be1scouting.com will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of www.be1scouting.com, or as to the accuracy, reliability or content of any information, service provided through www.be1scouting.com.
ii. The website www.be1scouting.com. is provided on an “as is” basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to these terms and conditions.
iii. In accordance with the children’s online privacy protection rule you as the parent or guardian of a minor have read and agree to the terms of use, and take full responsibility for the minor based on the information below. The child’s telephone number, e-mail and exact address are not displayed publicly, only the major city location, height, hair colour, and age range are displayed publicly for the purposes of modelling and talent agents, scouts, and industry professionals to view, and contact the child for castings.
iv. The website www.be1scouting.com will never require a child to disclose more information than is reasonably necessary to participate in an activity as a condition of participation. Agents, and/or industry professionals, as a third party, may request a child’s information for a booking or casting, www.be1scouting.com will not make this information available to agents, or anyone requesting it, without first receiving permission from you, the parent/guardian, via e-mail. www.be1scouting.com is not responsible for or liable to the actions of any third party who is not under any contract or agreement with www.be1scouting.com other than the terms and conditions set forth here. You, the parent/guardian can review the child’s personal information, ask to have it deleted and refuse to allow any further collection or use of the child’s information. Simply send an email to us with such requests.
v. The website www.be1scouting.com has guidelines regarding posting of appropriate images, email addresses, content, and links. You agree to read and adhere to the guidelines as posted throughout the site. Your use of the service and the sites is at your own risk. Neither www.be1scouting.com nor any of its subsidiaries, divisions, affiliates, agents, representatives or licensors shall be liable to you or anyone else for any loss or injury or any direct, indirect, incidental, consequential, special, punitive or similar damages arising out of your access or use of, or your inability to access or use, the service and the sites and the information available on the service and the sites or arising out of any action taken in response to or as a result of any information available on the service and the sites. You hereby waive any and all claims against www.be1scouting.com and or its subsidiaries, divisions, affiliates, agents, representatives and licensors arising out of your use of the service and the sites and the information available thereof. Due to the instant access nature of the www.be1scouting.com web site and service, www.be1scouting.com will not be responsible for refunding any credit card payment, debit card payment, UPI payment or any other way/ form of payment inclusive of a payment gateway. You hereby waive any and all claims against www.be1scouting.com and their subsidiaries, divisions, affiliates, agents, representatives and licensors for payments and/or compensation claims arising out of your use of the service and the sites and the information available thereof.
vi. The website www.be1scouting.com has a strict policy regarding the posting of semi-nude, nude, sexually suggestive and explicit images to its web pages. Semi-nude, nude, sexually explicit or suggestive images, as determined by www.be1scouting.com, will not be permitted on this site. www.be1scouting.com reserves the right to remove content that it deems in violation of this policy from its site without notice. www.be1scouting.com may, at its discretion, reject the applicant’s registration, without notice, and without refund, if the applicant continues to violate this policy.
vii. The website www.be1scouting.com does not support bandwidth theft/ hacking, the linking of images from www.be1scouting.com to other sites, or the misuse of links from other sites to www.be1scouting.com. Anyone found linking images from www.be1scouting.com to other sites, copying content from www.be1scouting.com, or inappropriately linking to www.be1scouting.com (to increase their views – through use of hidden frames, or using programs to artificially raise page views, etc.) Will result in permanent removal from www.be1scouting.com without notification, and may necessitate the notification of the appropriate state government authorities.
viii. Usage: as an applicant of www.be1scouting.com you give your express permission to www.be1scouting.com to use your photographs and/or other likenesses to promote you to international agencies, clients, photographers, and the reputation and services of www.be1scouting.com, and/or its affiliated companies.
ix. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behaviour, negligence, or under any other cause of action. Applicant specifically acknowledges that Be 1 Scouting is not liable for the defamatory, offensive or illegal conduct of other applicants or third-parties and that the risk of injury from the foregoing rests entirely with applicant.
x. In no event will Be 1 Scouting, or any person or entity involved in creating, producing or distributing www.be1scouting.com, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use www.be1scouting.com. Applicant hereby acknowledges that the provisions of this section shall apply to all content on the site.
xi. In addition to the terms set forth above neither, Be 1 Scouting, nor its affiliates, information providers or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within www.be1scouting.com, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages.
M. PUBLICITY
i. You agree to take part in reasonable Competition publicity (during the relevant Competition Period and thereafter) requested by Us and you agree that you may be filmed, photographed or otherwise recorded by Us or other third parties for this purpose. You agree that your name, likeness, voice and statements may be published throughout the world in any media now known or in the future devised in connection with your participation in the Competition and/or in the exercise of advertising, publicity and marketing rights undertaken by Us.
ii. All publicity rights created during or after the competition will be held by Be 1 Scouting and Be 1 Scouting will not be obligated or liable to pay or compensate in any way or other to the applicant.
N. SAFETY AND COVID-19 GUIDELINES AND PROTOCOLS
i. The Team Be 1 Scouting will not accept any responsibility for the safety of participants or by standers or persons accompanying the participants/ visitors during any event or audition.
ii. The organisers will not be held liable in any way for any death/ permanent injury/ temporary injury arising out of any mishaps, accident, damage, or any other irregularity before/ during and or after the event.
iii. Owing to the recent conditions surrounding the covid-19 pandemic, as a pre-condition to gaining access to the venue (events and theatres) you are required to be fully vaccinated and may be required to display your valid covid-19 vaccination certificate/s at the venue as per the various government norms/ regulations/ guidelines prevailing in the state/ union territory. The venue provider and governing authorities reserve the right to exclude any user from the venue if there are sufficient grounds to believe so for failure to abide by the covid-19 protocols. You agree to exit without protest or refund. You are required to check the restrictions as applicable in their state/ union territory.

Use of mask is mandatory for all participants and the visitors and are also required to ensure and follow the social distancing norms provided by Be 1 Scouting or the local governments at all times. The venue and Be 1 Scouting reserve the right to change or modify the terms and conditions at all times.
v. Be 1 Scouting does not assume any responsibility with regards to any injury or complications due to covid-19 accrued as a result of your participation.
vi. These terms and conditions may vary depending on the state or union territory where the event is held and are subject to changes as applied by the local governments.
vii. The above Covid-19 guidelines are mandatory across all of India.
O. FORCE MAJEURE
Neither party will be responsible for any failure or delay in performance due to circumstances beyond its reasonable control, including, without limitation, acts of god, war, riot, embargoes, acts of civil or military authorities, fire, floods, earthquakes, Pandemics, Epidemics accidents, service outages resulting from equipment and/or software failure and/or telecommunications failures, power failures, network failures, failures of third party service providers (including providers of internet services and telecommunications). The party affected by any such event shall notify the other party within a maximum of Fifteen (15) days from its occurrence. The performance of these Terms and Conditions shall then be suspended for as long as any such event shall prevent the affected party from performing its obligations under these Terms and Conditions. Be 1 Scouting shall not be liable to refund/ return any fees or any registration amount under the abovementioned circumstances.
